Terms of Service

These Terms govern the relationship between ACTIWELL JOINT STOCK COMPANY (hereinafter 'Actiwell', 'we') and the user ('you') when accessing and using the Actiwell platform, including web applications, mobile apps, APIs, and related services.

By registering an account or using any part of the service, you confirm that you have read, understood, and agreed to be bound by these Terms.

• Platform: The entire Actiwell software ecosystem including the management CMS, customer app, staff app, and API.
• User: Any individual or organization accessing or using the Platform.
• Studio: A gym, yoga studio, fitness center, or sports facility using the Actiwell Platform.
• Content: All data, information, text, and images uploaded or entered by users into the Platform.
• Service: Features and functionalities provided by Actiwell including CRM, membership management, booking, payments, and reporting.

Actiwell provides a fitness studio operations management platform including: CRM and membership management, package and e-contract management, class and PT booking, QR and biometric check-in, payment processing (cash, QR, card), revenue reporting and analytics, and mobile apps for customers and staff.

Actiwell reserves the right to change, suspend, or discontinue any feature of the Service with a minimum of 30 days' prior notice, except where required by law.

You have the right to access and use the Platform according to your subscribed service tier. You have the right to export your data and request technical support within your service tier.

You are obligated to:

• Provide accurate information upon registration and update it when changes occur.
• Maintain the security of login credentials and be responsible for all activities under your account.
• Not use the Platform for purposes that violate Vietnamese law or harm other users.
• Not attempt unauthorized access, reverse engineering, or interference with Actiwell's systems.
• Not use the Platform to send spam, distribute malware, or commit fraud.

Service fees are charged monthly based on the selected package and actual membership count. Payment is due at the beginning of each billing cycle.

Refunds are considered within 7 days of payment if the service is non-functional due to a technical error on Actiwell's part. Actiwell does not refund for non-use or early account cancellation.

Actiwell makes every effort to ensure the continuity, security, and accuracy of the Service but does not guarantee 100% uninterrupted or error-free operation. Actiwell is not liable for indirect damages, revenue loss, or data loss arising from service interruptions beyond our reasonable control.

Actiwell's total liability in any circumstance shall not exceed the total service fees you paid in the preceding 3 months.

You may terminate use of the Service at any time by notifying Actiwell in writing at info@actiwell.co. Your data will be retained for 90 days after termination for export purposes, then permanently deleted.

Actiwell may suspend or terminate your account immediately if you breach these Terms, violate the law, or harm other users or the system.

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from or related to these Terms shall be resolved in the competent court in Hanoi City.
